Terms & Conditions

These Terms & Conditions (“Terms”) govern your engagement with Level Up Media (“Company,” “we,” “us”) for social media management, content creation, and CRM services. By engaging our services, you agree to these Terms.

1. Services

Level Up Media offers:

Social Media Management & Content Creation – Includes posting, content strategy, and graphics creation.

CRM Setup & Management – Includes CRM configuration, workflow setup, and training for your team.

Specific services and deliverables are outlined in your signed proposal or onboarding agreement.

2. Payment & Fees

Packages

Basic Package: Social media & content creation (no CRM).

CRM Package: Includes CRM setup + social media/content creation.

Billing & Plan Duration

Monthly, 6-month, or 1-year plans available.

CRM packages require a 1-year minimum plan.

Setup fees apply for CRM onboarding.

Payment Terms

Payments are due per the selected plan schedule.

Late payments may result in suspension of services until payment is received.

3. Onboarding & Client Responsibilities

Clients must provide:

Access to social media accounts, CRM, branding assets, and any relevant content.

Accurate business information and timely feedback to ensure efficient service delivery.

Level Up Media will:

Provide a streamlined onboarding process to ensure quick, efficient setup.

Notify clients of any delays due to missing information or resources.

4. Client Conduct

Clients agree to:

Provide accurate, truthful, and legal content for posting or CRM use.

Avoid requesting services outside the agreed-upon scope unless a new agreement is signed.

Maintain professional communication and respect timelines for feedback.

5. Confidentiality

Both parties agree to maintain confidentiality regarding business information, account credentials, strategies, and any proprietary materials. Level Up Media will not share client information without explicit consent.

6. Intellectual Property

Content created by Level Up Media remains the intellectual property of Level Up Media until full payment is received.

Upon full payment, ownership of content transfers to the client for the agreed-upon use.

CRM workflows and templates remain the property of Level Up Media unless otherwise agreed in writing.

7. Termination

Either party may terminate the agreement with written notice.

Paid fees are non-refundable unless otherwise agreed.

Services may be suspended for non-payment or violation of these Terms.

8. Limitation of Liability

Level Up Media is not liable for indirect, incidental, or consequential damages.

We strive for best practices but cannot guarantee specific outcomes, follower growth, or sales results.

9. Dispute Resolution

Any disputes will be resolved first through good-faith negotiation.

If unresolved, disputes will be handled under San Francisco Bay Area, California law.

10. Amendments

Level Up Media may update these Terms with written notice. Clients continuing services after updates agree to the revised Terms.

By signing the onboarding form or engaging our services, you acknowledge that you have read, understood, and agreed to these Terms & Conditions.
